Terms of Service

Welcome to Racevo. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Site”). By accessing or purchasing from the Site, you agree to these Terms.

1) Who We Are

Racevo is owned and operated by KIMBERLYRB LLC (see Store Information at the end of this page). We create fan-made motorsport apparel organized by Driver and Team collections.

Disclaimer: Designs are fan-made. We are not affiliated with, endorsed by, or sponsored by NASCAR, Formula 1, MotoGP, or any drivers/teams. Names are used for descriptive purposes only.

2) Eligibility & Account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.
  • You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

3) Orders & Acceptance

  • Your order is an offer to buy; we may accept or decline any order at our discretion (e.g., stock/print availability, suspected fraud, pricing or listing errors).
  • If we cancel after you are charged, we will refund you in full.

4) Pricing, Taxes & Promotions

  • Prices are in USD and may change without notice.
  • We may collect sales tax where required by law (rates and rules vary by location).
  • Promotions, discount codes, or free-shipping offers are subject to their stated terms and may be modified or withdrawn at any time.

5) Payment Method

  • We accept PayPal only (including PayPal Guest Checkout where available).
  • Payment is processed by PayPal; we do not store full card details.
  • By submitting a payment, you represent that you are authorized to use the selected method and that the information is accurate.

6) Production, Shipping & Delivery

  • 2D Printed (US print & ship): typical handling 1–2 business days; transit 4–7 business days.
  • 3D/AOP (Asia partners): typical handling 3–5 business days; transit 10–12 business days.
  • Shipping region: United States (U.S.) only at this time.
  • Multiple-item orders may ship separately with different tracking numbers.
  • Risk of loss passes to you upon carrier’s acceptance of the package. Delivery timelines are estimates and not guaranteed.

7) Returns, Exchanges & Refunds

  • We offer 60-day free returns from delivery for most items in unused condition.
  • Exclusions include personalized/custom items (unless defective), final-sale items, and normal wear and tear.
  • Start a return by contacting us with your order number; we provide a prepaid return label for U.S. returns.
  • Refunds are issued to the original payment method after inspection, typically within 3–7 business days.

8) User Content (Reviews, Messages)

If you submit reviews, images, or messages (“User Content”), you grant Racevo a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for store operations and marketing. You represent you own or have rights to the content and that it does not violate any laws or third-party rights.

9) Intellectual Property

All Site content (designs, text, graphics, logos, product mockups) is owned by or licensed to Racevo and protected by applicable laws. Except as permitted by law or with our written consent, you may not copy, distribute, or create derivative works from our content.

10) Prohibited Uses

You agree not to use the Site to:

  • Engage in illegal, fraudulent, or deceptive activity;
  • Infringe intellectual property or privacy rights;
  • Interfere with Site security or operations;
  • Collect data from the Site via scraping or automated means without permission.

11) Warranties & Disclaimers

The Site and products are provided “as is” and “as available.” To the maximum extent permitted by law, Racevo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the fullest extent permitted by law, Racevo and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Site or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless Racevo and its affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or violation of any law or third-party right.

14) Third-Party Services

We use service providers (e.g., PayPal, carriers, production partners). Those services are governed by their own terms and policies. Racevo is not responsible for third-party acts or omissions.

15) Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect and use personal information.

16) Governing Law & Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Santa Fe County, New Mexico, for any disputes that are not subject to small-claims procedures.

17) Changes to the Terms

We may update these Terms from time to time. The Effective date above will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.
